Terms & Conditions
When working with Kimberly Duran (Swoon Worthy Ltd.), you agree to the following terms of business, which supersede any other:
Payment terms: 7 calendar days from date of invoice by BACS. Maximum 30-day payment terms must be agreed in advance. Payment by Paypal must be agreed in advance and may incur an additional charge. I reserve the right to invoice for 50% of the project upfront should the monthly value exceed £1000.00. Payment by cheque will not be accepted.
Late payment fees: Invoices unpaid after 30 days will incur a fixed charge of £40, £70 or £100 depending on the size of the invoice (under £1,000, between £1001 – £10,000, and £10,001 and up, respectively), plus interest at 8% over the Bank of England base rate. This is in accordance with the Late Payment of Commercial Debts Regulations 2008.
Purchase Orders: If a brand or agency has to generate a purchase order before receiving an invoice, this must be done before any work takes place.
Copyright: All images, video, audio and copy remain the property of Kimberly Duran unless otherwise agreed. Additional charges may apply for usage across social media, press, product pages or internal communications.
Exclusivity: Any brand exclusivity must be agreed in advance and will be subject to a fee, per calendar month.
Agreements: The agreement of a fee and due date denotes agreement for a project to go ahead.
Cancellation Fees: Should work be cancelled after an agreement takes place, a kill fee will be required. The kill fee is calculated as follows: If work has been agreed but not completed, 50% of total fee is due. If work has been completed but not published, 75% of total fee is due. If work has been completed and published, 100% of total fee is due.
Availability: My general work hours are 9am-5pm Monday-Friday. If a task is requested to be done outside of these hours, overtime may apply.
Alterations: Any alterations to a brief, or additional requirements after agreement, may result in an additional fee being charged.
Approval: Content can be provided for approval before publication.
Edits: One round of edits will be offered, unless otherwise agreed in advance.
Links: All links to a brand’s website will be no follow.
Disclosure: All commercial posts will be clearly marked in the body of the post, and explained as a commissioned post at the end. All social promotion of commercial posts will be clearly marked as an #ad or #sp or will make use of the branded content tools available on Facebook and Instagram.
